Mayor Tim Riley was served with a Petition for Mandamus against the City of Gonzales, filed by Liberty Fence & Supply LLC (Liberty Fence) on October 9. Also named Party-Defendant is former Chief Financial Officer Brandon Boylan who no longer serves in the Finance Department but retains the title of City Clerk. Boylan’s inclusion concerns an April records request. Liberty Fence also seeks satisfaction of five outstanding invoices submitted to the city, $23,600 that have not been satisfied.
Mayor Riley declined comment, pointing to the city’s responsive pleadings “that will clear things up. The City of Gonzales does not ow Liberty Fence anything.”
The matter had been set for a Rule to Show Cause hearing in December. That was pushed up to Thursday to take up the request for Mandamus (a judicial remedy requiring a government official to perform an act legally required.
At the end of March, Riley’s Chief of Staff presented concerns over Liberty Fence’s dealings with the city. Wade Petite recommended a civil suit against “the unlicensed fence company” at the time. The recommendation was met by insufficient support on the City Council, three of whom would have had to vote to seek legal redress.
